Clay County Recording Requirements

Documents filed for recording in Clay County must follow Indiana's statewide formatting rules under IC 36-2-11-16.5. White paper measuring 8.5 by 11 or 8.5 by 14 inches is required. The top margin on the first page must be at least 2 inches to leave room for the recorder's stamp. Other margins must be at least 0.5 inches. Text must be in at least 8-point type and must be dark enough to scan and reproduce clearly. Documents that fail any of these requirements will be returned without recording.

Every deed recorded in Clay County must include the physical mailing address of each grantee, as required by IC 32-21-2-3. The person who prepared the document must include their name and address on the instrument under IC 36-2-11-15. That same statute requires the recorder to redact Social Security numbers from documents before making them publicly available. Before a deed can be accepted for recording, it must carry an auditor's stamp from the Clay County Auditor under IC 36-2-11-14, confirming that all property transfer taxes have been reviewed. Take the deed to the auditor's office first, then bring it to the recorder. All deeds and mortgages must be notarized per IC 33-42-10-2, with a proper notary signature and seal. If two or more parties on a deed share the same name or very similar names, IC 36-2-11-16 applies to how that situation is indexed.

The Indiana Recorders Association publishes the Indiana Recording Manual, which covers all of these requirements in detail. Attorneys and title companies who regularly file in Clay County should review this manual to keep rejections low.
